PLEASE READ THIS DISCLAIMER CAREFULLY BEFORE USING BOOXDAY. This disclaimer limits our liability and explains important aspects of the BooxDay app and service. By using BooxDay, you acknowledge and agree to all terms in this disclaimer.

1. About BooxDay and the Developers

1.1 Independent Developer

BooxDay is developed and maintained by a small, independent software developer. We are not a large corporation or subsidiary of any technology company. We create BooxDay as a passion project and productivity tool for the Onyx Boox community.

1.2 Our Mission

Our goal is to support and enhance the Onyx Boox device experience by providing specialized calendar and planning software optimized for e-ink displays and stylus input. We aim to fill a gap in the market for handwriting-first, e-ink-native productivity tools.

1.3 No Competing Interests

We have no competing interests with Onyx Boox. We do not manufacture hardware, develop competing operating systems, or create alternative e-ink devices. BooxDay exists solely to complement and enhance Onyx Boox tablets.

2. No Affiliation with Onyx Boox

2.1 Independent Third-Party Application

BOOXDAY AND ITS DEVELOPERS ARE NOT AFFILIATED WITH, ENDORSED BY, SPONSORED BY, APPROVED BY, OR IN ANY WAY OFFICIALLY CONNECTED TO ONYX INTERNATIONAL INC. OR ANY OF ITS SUBSIDIARIES, AFFILIATES, OR AUTHORIZED DISTRIBUTORS.

2.2 No Misrepresentation

BooxDay is an unofficial, third-party application. We do not claim to be, represent, or misrepresent ourselves as:

  • An official Onyx Boox product or service
  • A partner, collaborator, or authorized developer of Onyx Boox
  • Endorsed, approved, or certified by Onyx Boox
  • Part of the Onyx Boox software ecosystem or App Store
  • Having any special relationship with Onyx Boox

2.3 Use of Onyx Boox Name and Trademarks

The name "Onyx Boox" and related trademarks are the property of Onyx International Inc. Our use of these names is purely descriptive to indicate device compatibility (e.g., "designed for Onyx Boox tablets"). This constitutes fair use under trademark law and does not imply endorsement or affiliation.

2.4 No Support from Onyx Boox

Onyx Boox does not provide support, updates, or assistance for BooxDay. If you experience issues with BooxDay, do not contact Onyx Boox—they cannot help. Contact us directly at booxdaycalendar@gmail.com.

2.5 No Warranty from Onyx Boox

Onyx Boox makes no warranties or guarantees regarding BooxDay's functionality, compatibility, or safety. Installing BooxDay is entirely at your own risk and may void warranties or violate device policies.

3. No Maintenance or Development Obligations

3.1 No Guaranteed Updates

WE ARE UNDER NO OBLIGATION TO MAINTAIN, UPDATE, ENHANCE, OR CONTINUE DEVELOPMENT OF BOOXDAY. Development of BooxDay is provided at our sole discretion as an independent developer. We make no promises or commitments regarding:

  • Bug fixes or patches
  • New features or functionality
  • Compatibility updates for new Android versions or Boox devices
  • Performance improvements or optimizations
  • Security updates
  • Technical support or customer service

3.2 App May Become Outdated

BooxDay may become obsolete, incompatible, or non-functional over time due to:

  • Android OS updates
  • Changes to Onyx Boox firmware or SDK
  • Google API changes (Calendar, Drive, etc.)
  • Discontinuation of third-party services (OpenRouter, AI models)

We are not obligated to address any of these issues. The app may stop working without warning or recourse.

3.3 No Technical Support Guarantee

While we may provide customer support on a best-effort basis, we guarantee no response time, resolution, or support availability. Support requests may go unanswered. Feature requests may be ignored. Bug reports may not be addressed.

4. Service Discontinuation and Distribution Changes

4.1 Right to Discontinue

WE RESERVE THE RIGHT TO DISCONTINUE BOOXDAY AT ANY TIME, FOR ANY REASON, WITHOUT PRIOR NOTICE. This includes:

  • Removing the app from the Google Play Store
  • Terminating backend servers and APIs
  • Shutting down AI features and services
  • Ceasing all development, maintenance, and support
  • Deleting the website and documentation

We have no obligation to provide advance notice, transition periods, or refunds in the event of discontinuation.

4.2 Google Play Store Exit

We may choose to leave the Google Play Store and distribute BooxDay through alternative channels for economic, policy, or business reasons. This may occur if:

  • Google Play Store fees become unsustainable
  • Google policies conflict with our business model
  • We prefer direct distribution to reduce costs

If we leave Google Play Store, existing installations may continue to work, but updates and support through Google Play will cease.

4.3 Payment Processing Changes

We may switch from Google Play billing to alternative payment processors (Stripe, PayPal, direct bank transfer, cryptocurrency, etc.) if we leave the Google Play Store or find it economically necessary. This may affect:

  • How subscriptions are billed and renewed
  • Refund policies and procedures
  • Payment methods accepted
  • Pricing structure and currency

Users who purchased through Google Play may not have access to app updates or features if we switch payment systems. We are not obligated to honor previous purchases across different payment platforms.

4.4 No Refund Obligation on Discontinuation

If we discontinue BooxDay or exit Google Play Store, we are not obligated to provide refunds for previous purchases or subscriptions. Refunds are subject to Google Play Store policies (if applicable) or our discretion. You acknowledge this risk when purchasing.

5. Third-Party AI Services and Data Processing

5.1 Use of OpenRouter and AI Models

BooxDay uses OpenRouter.io as a routing service to access AI models from various providers (Google, Meta, Mistral, Anthropic, open-source models, etc.). These are third-party services that we do not own, control, or operate.

5.2 OpenRouter Terms of Service

By using BooxDay's AI features, you agree to OpenRouter's Terms of Service: https://openrouter.ai/terms. We do not control OpenRouter's terms and are not responsible for changes to their policies.

5.3 OpenRouter Privacy Policy

Your data sent to AI features is subject to OpenRouter's Privacy Policy: https://openrouter.ai/privacy. We do not control OpenRouter's data handling practices.

5.4 No Control Over AI Model Providers

WE DO NOT CONTROL, AND ARE NOT RESPONSIBLE FOR, HOW AI MODEL PROVIDERS (Google, Meta, Mistral, Anthropic, etc.) HANDLE, STORE, PROCESS, OR USE YOUR DATA. Each AI provider has its own:

  • Terms of Service
  • Privacy Policy
  • Data retention policies
  • Model training practices
  • Security measures

It is your responsibility to review these policies before using AI features. We cannot and do not guarantee compliance by third-party AI providers.

5.5 Risk of Data Exposure and Model Training

WARNING: AI FEATURES CREATE POTENTIAL RISKS FOR YOUR DATA. By using AI features (handwriting recognition, voice input, task parsing, image OCR), you acknowledge that:

  • Your data may be transmitted to and stored by third-party AI providers
  • AI providers may use your data to train or improve their models
  • Data transmission may be intercepted or exposed due to security breaches
  • AI providers may change their policies or data handling practices
  • Data retention periods may be longer than disclosed or indefinite
  • Your data may be subject to government requests, subpoenas, or legal processes

WE ARE NOT RESPONSIBLE FOR ANY DATA EXPOSURE, MISUSE, UNAUTHORIZED ACCESS, OR TRAINING USE BY AI PROVIDERS.

5.6 Free Models and Shared Infrastructure

BooxDay primarily uses free or low-cost AI models available through OpenRouter. These models are:

  • Shared infrastructure used by thousands of users
  • Subject to rate limiting, quotas, and availability restrictions
  • May have lower privacy protections than paid enterprise models
  • May be discontinued or removed without notice

We provide access to these free models as a convenience and creative feature. We make no guarantees about their availability, quality, privacy, or suitability for your use case.

5.7 User Responsibility for AI Usage

YOU ARE SOLELY RESPONSIBLE FOR HOW YOU USE AI FEATURES AND WHAT DATA YOU SUBMIT. Do not use AI features for:

  • Highly sensitive personal information (passwords, financial data, medical records)
  • Confidential business information
  • Information you cannot afford to have exposed or used for training
  • Illegal, harmful, or prohibited content

We disclaim all liability for your choice to use AI features despite these risks.

6. No Responsibility for Third-Party Services

6.1 Third-Party Integrations

BooxDay integrates with third-party services including:

  • Google Calendar (Google LLC)
  • Google Drive (Google LLC)
  • OpenRouter.io (OpenRouter)
  • Various AI model providers (Google, Meta, Mistral, Anthropic, etc.)
  • Onyx Boox SDK (Onyx International Inc.)

WE ARE NOT RESPONSIBLE FOR THE AVAILABILITY, FUNCTIONALITY, PRIVACY PRACTICES, SECURITY, OR TERMS OF SERVICE OF ANY THIRD-PARTY SERVICE.

6.2 Third-Party Service Changes

Third-party services may:

  • Change their APIs or functionality without notice
  • Discontinue services or features
  • Change pricing or access policies
  • Modify terms of service or privacy policies
  • Experience downtime, outages, or security breaches

We are not liable for any disruption or loss caused by third-party service changes.

6.3 User Obligation to Review Third-Party Terms

IT IS YOUR RESPONSIBILITY TO REVIEW AND ACCEPT THE TERMS OF SERVICE AND PRIVACY POLICIES OF ALL THIRD-PARTY SERVICES USED BY BOOXDAY. We cannot enforce third-party compliance and make no representations about their practices.

7. Disclaimer of Warranties

7.1 "AS IS" and "AS AVAILABLE"

BOOXDAY IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We disclaim all warranties including but not limited to:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or completeness
  • Reliability or availability
  • Error-free operation
  • Security or privacy

7.2 No Warranty of Accuracy

WE ARE NOT RESPONSIBLE FOR THE ACCURACY OR QUALITY OF ANY OUTPUT FROM BOOXDAY OR AI FEATURES. AI-generated content, OCR results, voice transcriptions, and task parsing may be inaccurate, incomplete, inappropriate, or harmful. You use all features at your own discretion and risk.

7.3 No Warranty of Compatibility

We do not warrant that BooxDay will work on all Onyx Boox devices, Android versions, or configurations. Compatibility may change without notice.

8. Limitation of Liability

8.1 Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO BOOXDAY SHALL NOT EXCEED THE GREATER OF:

  • The amount you paid for BooxDay in the 12 months prior to the claim, OR
  • $100 USD

8.2 No Liability for Indirect Damages

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits or revenue
  • Loss of data or information
  • Loss of business opportunities
  • Loss of goodwill or reputation
  • Costs of substitute products or services
  • Personal injury or emotional distress

This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, etc.) and even if we were advised of the possibility of such damages.

8.3 No Liability for Third-Party Actions

We are not liable for:

  • Actions or omissions of third-party AI providers
  • Data breaches or security incidents at third-party services
  • Changes to third-party APIs, terms, or availability
  • Google Play Store policies or billing issues
  • Device manufacturer (Onyx Boox) hardware or firmware issues

9. Indemnification

YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS BOOXDAY DEVELOPERS AND ANY AFFILIATES FROM ANY CLAIMS, DAMAGES, LOSSES, LIABILITIES, AND EXPENSES (INCLUDING REASONABLE LEGAL FEES) ARISING FROM:

  • Your use or misuse of BooxDay
  • Your violation of these terms or any applicable laws
  • Your content or data submitted to AI services
  • Claims that your use of BooxDay violates third-party rights

10. Assumption of Risk

BY USING BOOXDAY, YOU ACKNOWLEDGE AND ASSUME ALL RISKS, INCLUDING BUT NOT LIMITED TO:

  • Data loss or corruption
  • Privacy breaches or data exposure
  • App malfunction or unavailability
  • Inaccurate AI output causing harm or loss
  • Discontinuation of the app or features
  • Changes to pricing or distribution
  • Incompatibility with your device
  • Conflicts with other apps or services

You use BooxDay entirely at your own risk.

11. Changes to This Disclaimer

We may update this disclaimer at any time without notice. Continued use of BooxDay after changes constitutes acceptance of the updated disclaimer. It is your responsibility to review this page periodically.

12. Governing Law and Jurisdiction

This disclaimer is governed by the laws of the United States. Any disputes shall be resolved in courts located in the United States.

13. Severability

If any provision of this disclaimer is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remainder remains in full force and effect.
